If you or your baby suffered from an birth injury during child birth you may be able to claim compensation.
Bringing a child in to the world is one of the most amazing things that can happen. So when your birth ends in a birth injury it can be a traumatic experience. If you have suffered from an injury or your child has suffered from a birthing injury it is important to get in touch with a solicitor as soon as possible to find out if you have a valid claim.
Birth injuries can happen during 3 stages of pregnancy – antenatal (before birth), labour (during birth) and neonatal (after birth).
Take a look at the different stages below to find out what types of injuries or medical conditions can happen.
Antenatal
Midwives and doctors should book you regular appointments during your pregnancy to check on how the mother and the baby are doing. During these appointments you will be given a number of health checks to make sure that everything is running smoothly. The health checks you should be given include, blood pressure, blood tests, urine tests, checking the baby’s size, heartbeat and position. Doctors and midwives should also ask the mother questions about how she is feeling generally.
When these checks are not completed it could result in the incorrect medication being prescribed or missing the signs that the foetus distressed. Which in turn result in medical conditions such as, Ectopic and Molar Pregnancies, Pre Eclamsia, group B Strep or a Ruptured Placenta.
Labour
During childbirth a baby’s body is very fragile and vulnerable. Injury to any part of the body during childbirth can result in catastrophic injuries and can be devastating to both the mother and baby.
A doctor, obstetrician or midwife could act negligently if they perform a procedure they are not rained to do or incorrectly use equipment they do not know how to use. There are a vast number of injuries which could arise following a birth injury. Some of the more common ones include, brain damage, Erb’s Palsy, Cerebral Palsy, fractures and scarring.
A mother could also experience a birthing injury during labour. Vaginal lacerations and irreparable damage to the pelvic muscles are the more common.
Neonatal
Neonatal birth injuries are complications which arise up to 28days following delivery. Following child birth you should be visited within 10 days by your health visitor. The health visitor will ask the mother questions about how they are getting on and will take a look at the baby. During these 28 days if your baby has developed an illness or injury a doctor, midwife or health visitor should be able to spot this. If they are not spotted there may be a case for medical negligence.
