How much could My Claim be Worth?
In medical negligence compensation is split in to 2 areas, general damages and special damages.
General damages are awarded for the pain, suffering and loss of amenity which is caused by the injury or illness. Loss of amenity relates to the impact the injury or illness may have on your quality of life. They include loss of enjoyment in life, loss of loss of companionship, loss of reputation etc. They are not easily quantifiable and solicitors use the Judicial Board of Studies as a guide for what compensation amounts should be awarded.
Special damages are awarded for any financial losses suffered due to the injury or illness. They will include, loss of earnings, medical bills, medication costs, house and garden adaptations, travelling costs, care costs and any items brought as a result of the injury or illness. Solicitors will also calculate if there are any future loss of earnings and they will also be included in your compensation claim. It is important to keep all receipts as this will make it easier to claim back.
